AX Systems - Software License Agreement

IMPORTANT - READ CAREFULLY. This License Agreement ("AGREEMENT") is a legal agreement between you (either an individual or an entity) and AX Systems for the AX Systems software product ("SOFTWARE PRODUCT"). By installing, copying, or otherwise using the SOFTWARE PRODUCT, you agree to be bound by the terms of this AGREEMENT. If you do not agree to the terms of this AGREEMENT, you are not authorized to install, copy, or otherwise use the SOFTWARE PRODUCT.

The SOFTWARE PRODUCT is protected by international copyright treaties, as well as other intellectual property laws and treaties. The SOFTWARE PRODUCT is licensed, not sold.

This AGREEMENT grants you the following rights:

You may install and use one copy of the SOFTWARE PRODUCT on a single computer. The primary user of the computer on which the SOFTWARE PRODUCT is installed may make a second copy for his or her exclusive use on a portable computer.

You may also copy or install a copy of the SOFTWARE PRODUCT on a storage device, such as a network server, used only to install or run the SOFTWARE PRODUCT on your other computers over an internal network; however, you must acquire a license for each separate computer. A license for the SOFTWARE PRODUCT may not be shared or used concurrently on different computers.

Unregistered SOFTWARE PRODUCT may be used during 30 days after installation for evaluation purposes only. To continue using the SOFTWARE PRODUCT after termination of evaluation period, you should pay for the registration of the SOFTWARE PRODUCT to get the registration key. Otherwise you should remove the SOFTWARE PRODUCT and all its archival copies.

Unregistered SOFTWARE PRODUCT may be freely distributed provided that the original distribution package was not modified. No person or company may charge a fee for the distribution without written permission from AX Systems.

You may not reverse engineer, decompile, or disassemble the SOFTWARE PRODUCT, except that such activity (only to the necessary extent) is expressly permitted by applicable law notwithstanding this limitation.

You may permanently transfer all of your rights for the SOFTWARE PRODUCT provided you retain no copies, you transfer all component parts of the SOFTWARE PRODUCT and the recipient agrees to the terms of this AGREEMENT.

This AGREEMENT will be terminated if you fail to comply with its terms and conditions. In such event, you must destroy all copies of the SOFTWARE PRODUCT and all of its component parts.

All title and copyrights to the SOFTWARE PRODUCT (including any redistributables, images and texts incorporated into the SOFTWARE PRODUCT) and any its copies are owned by AX Systems. The SOFTWARE PRODUCT is protected by copyright laws and international treaty provisions. Therefore, you must treat the SOFTWARE PRODUCT like any other copyrighted material protected by copyright law except that you may install the SOFTWARE PRODUCT on a single computer provided you keep the original solely for backup or archival purposes.

The SOFTWARE PRODUCT is provided "as is" - without any warranty, either expressed or implied. AX Systems disclaims any warranties including warranties of merchantability or fitness for a particular purpose. The entire risk arising out of use or performance of the SOFTWARE PRODUCT remains with you.
In no case shall AX Systems be liable for any possible damages (including, without limitation, cases of loss of business profit, business interruption, loss of business information, or any other kinds of losses) arising out of use or inability to use the SOFTWARE PRODUCT, even if AX Systems has been advised on the possibility of such losses. As some states do not allow the exclusion or limitation of liability, the above limitation may not apply to you.
